What legal theory is Disney using to sue Florida Gov. Ron DeSantis?

Disney’s federal lawsuit against Republican Florida Gov. Ron DeSantis alleges that he violated several constitutional protections by retaliating against the company for its political speech.

The April 26 suit, filed Wednesday in the Northern District of Florida, seeks confirmation of contractual agreements reached between Disney and its self-governing improvement-district board before its renaming and takeover by DeSantis appointees.

Disney also is asking the court to overturn laws that made the board changes possible and to find that the new board’s renunciation of the contracts is unlawful.

Disney claims that DeSantis sought the legislation in retaliation for the company’s vocal opposition to the “Don’t Say Gay” law, which limits classroom discussion of sexual orientation and gender identity.

“This government action was patently retaliatory, patently anti-business and patently unconstitutional. But the governor and his allies have made clear they do not care and will not stop,” the suit said.

The agreements between Disney and its prior board were tools to secure long-term development plans on Disney property, according to the suit.

A development agreement permits Disney to use its land “up to a defined maximum development program,” including how much that Disney can devote to commercial, retail, restaurant and hotel space, according to the suit. The agreement also allows Disney to build one additional major theme park and two additional minor theme parks through 2032.

The other agreement was a declaration of restrictive covenants that give Disney the power to review the appearance of exterior improvements to its properties, require Disney approval for the district’s use of Disney names and characters, and ban the district from selling merchandise referring to Disney.

The new board still has the power to exercise limited governing powers, including the authority to impose some taxes, build and maintain roads, provide emergency services, adopt and enforce building codes, and operate utilities.

Study Finds Evidence for Tumors From Cellphone Radiation

The International Agency for Research on Cancer classified cellphones as a Group 2B “possible carcinogen” in 2011. Since then, evidence of harm has only grown stronger

Two major studies published in 2018 link cellphone radiation to DNA damage and cancer

Research by the National Toxicology Program (NTP) found “clear evidence” for heart tumors in male rats. These tumors started developing around week 70, and are similar to human acoustic neuromas that previous studies have linked to cellphone use

NTP also found “some evidence” of brain tumors and adrenal gland tumors in male rats, as well as “equivocal” or unclear evidence of tumors in female rats and mice of both genders

Corroborating evidence published by the Ramazzini Institute also shows a clear link between cellphone radiation and Schwann cell tumors, but at a much lower power level than that used by NTP, and below the U.S. safety limits set by the Federal Communications Commission

Longevity Strategies That May Be Highly Counterproductive

In the April 11, 2023, podcast above, Dr. Paul Saladino interviews Georgi Dinkov about the benefits of fasting, the risks of carbs, the hazards of fatty acids and the root causes of diabetes and cancer.

It’s nearly two hours long, but well worth your time to listen to several times at normal speed if you want to learn more about these topics. Dinkov is probably the most educated student of Ray Peat, who passed away around Thanksgiving 2022, leaving behind a legacy of iconoclastic wisdom on how to optimize biological health.

Title fraud: Broward Property Appraiser’s Office fights to prevent use of court system to steal homes

Imagine finding out that your home has been stolen from you. It may seem far-fetched, but it happens more often than you think. The Broward County Property Appraiser’s Office is fighting back like never before. Kevin Ozebek has tonight’s 7 Investigates.

Miguel Masias is fixing up this Fort Lauderdale home to sell.

He bought it as an investment, but last May, he got a phone call that shocked him.

Miguel Masias: “A detective called me one morning, telling me that somebody tried to steal my house.”

Police say Roosevelt Permenter went to the Broward County Recorder’s Office and tried to put the house in his name.

Miguel Masias: “He showed me a picture of the person who was trying to do that, and I said, ‘No, I don’t know this guy.’”

Using the court system to steal property is called title fraud.

Marty Kiar, Broward Property Appraiser: “It’s very rampant. I think South Florida is the title fraud capital of the world.”

Broward Property Appraiser Marty Kiar decided to fight the fraud, so he formed the Crimes Against Property Unit.

It’s the first of its kind in the state.

Lawyer’s paralegal was fooled by fraudster who changed wiring instructions, suit says

A Connecticut lawyer sent part of the proceeds from a home sale to a fraudster’s bank account, rather than the bank holding the mortgage, a negligence lawsuit alleges.

The lawsuit, filed April 24 in Connecticut superior court, was filed by home buyer Lesley Moody, who said the title to the home that she purchased is encumbered by the seller’s mortgage as a result of the goof-up.

Law360 has coverage.

William Cote, the lawyer for the seller, allegedly wired more than $159,000 to the wrong account after his paralegal presented him with what turned out to be a phony payoff statement. The money was supposed to be paid to the Freedom Mortgage Corp.

Cote had received a correct payoff statement with accurate wire instructions Aug. 10, 2022, the suit says. Before he made the payment, his paralegal received an email from an unknown third party who claimed to be the seller. The email said there was a new payoff statement.

When the email fraudster sent the new statement, it “specified wire instructions for a different bank and account—presumably one that the fraudster controlled,” the suit says.

The paralegal forwarded the new statement to Cote, even though it had “multiple material differences.”

Over 10,000 FBI Agents Can Access Data From Secretive Surveillance Program: Inspectors General

More than 10,000 federal employees could have access to data revealed by a secretive government surveillance program that has come under scrutiny because of alleged abuses, lawmakers were told by U.S. inspectors general.

At an April 27 House Judiciary subcommittee hearing, lawmakers heard from a panel of three witnesses associated with the U.S. Office of the Inspector General (OIG) responsible for oversight of the Foreign Intelligence Surveillance Act (FISA). The legislation gives intelligence agencies broad powers to conduct surveillance on foreigners suspected of spying for a foreign power or belonging to a terrorist group.

However, bipartisan concerns have been raised because the program also has the ability to collect information about U.S. citizens.

The Secret to Healing Stubborn Wounds

As antibiotic-resistant strains of bacteria continue to proliferate, when it comes to wound healing in animals, the use of medical-grade honey is getting lots of attention

While both table honey and medical-grade honey have antibacterial properties, highly processed table honey is akin to high fructose corn syrup, which is more likely to increase infection and, in my opinion, should never be used to treat topical wounds

Two common types of medical honey are manuka honey and greenhouse produced hydrophilic honey gel

I use manuka honey extensively with animal patients to heal resistant skin infections, burns, and large wounds that can’t be closed surgically
