I do understand what happened. As far as your immediate personal situation – I think you can win a lawsuit against the local P.D. that arrested you. I myself was arrested in what sounds to me to be an event bearing strong resemblance to yours some years ago. The court determined it was a false arrest on which grounds I was entitled to sue for personal injury and recover damages…
Now, you could use this immediate case as a sort of “public podium” for the underlying issues/questions of Constitutionality that you express here on your site and in you broadcasts.
I certainly believe that you should as these things are entirely relevant in the big picture.
Notwithstanding, I think I would separate those concerns in your mind for the moment and concentrate on winning a judgement against the cops. I believe you can and should show/prove – and they will admit to – making some “mistakes” in procedure when they arrested you and you will be entitled to a money judgement (could be fairly substantial), and any case against you will be dropped. You can then also get the entire record expunged.
Consequently, and sufficiently armed with the winnings from your successful counter-action in the court system, you should then proceed with perhaps some type of a class-action or multi-plaintiff civil rights complaint in the state or federal courts on behalf of all of us citizens, your listeners and followers, “similarly situated.”
I also would suggest that publicly posting all your pleadings, papers, and evidentiary records in the instant matter/case online through your website here and asking for feedback commentary would be helpful as well – as even the best lawyers do not sometimes know or think of everything. In other words, having your listener base as one big “think tank” of legal research and so forth at your disposal, for you (and your counsel assuming you are going to hire representation) should be a major advantage [Proverbs 11:14]. You (and your counsel) will be able to peruse such commentary for plausible citations and ideas.
